Local man sentenced for child abuse

Luis Garcia, a local man was sentenced on Febvruary 27 for two different charges for Child Abuse. The story begins two and a half years ago, on July 2, 2018. Child Protective Services contacted the Marshall County Sheriff’s Office for assistance with a child abuse investigation.

To begin the investigation, deputies interviewed the mother and father of the child in question. Deputies were informed that the child was brought to receive medical attention on a leg injury. Authorities and medical personnel had suspicions that the injury was not an accident – signs were pointing to Garcia.

According to police reports, all throughout the interviews, Garcia, a 47-year-old male from Madill proclaimed his innocence.

Once the conducted interviews by the Sheriff’s Office, DHS and Child Protective Services were completed, the evidence was presented to the District Attorney’s Office. An arrest warrant for Child Abuse by Injury, and Child Neglect was requested and approved. Garcia was arrested on July 25, 2018 on the bond amount of $100,000. He was also ordered to have no contact with the child.

After two and a half years of preliminary hearings and judicial motions, the case was set to be heard by a jury of Marshall County citizens. The case was heard on February 25, 2020 and the jury returned with a guilty verdict for both of the charges on February 27.

Garcia was subsequently sentenced to 10 years for the Child Abuse by Injury conviction and 15 years for the Child Neglect. They are set to run concurrent with each other.
