Steven Cryer, a local man, was arrested and charged with Rape by Instrumentation after a complaint was filed with the Marshall County Sheriff’s Office. On March 9, 2022, a Kingston resident entered the Marshall County Jail with allegations about Cryer.

Deputy Kristen Floyd was the officer who met the victim to get their account on the alleged incident. The victim claimed that the incident occurred Labor Day weekend, meaning it was on or around September 6, 2021.

She said that it all began at a family gathering where the adults were having fun and having a few drinks. It was alleged that Cryer, a 49-yearold male from Kingston, began making inappropriate comments. The victim noted that “everyone always blows it off due to it being family, and they don’t want [to] make a big deal about it.”

The inappropriate comment made the victim uncomfortable, so she decided to go inside and lay down. She went inside and laid down on the couch and covered up with a blanket.

The victim alleged that she was awakened by an odd feeling. She said once she wiped the sleep out of their eyes, the suspect was touching the victim inappropriately.

According to the police re port, the victim said that “the fear ran through her body, putting her in shock, feeling like she could not move, [or] speak for fear of retaliation.”

The victim then alleged that she heard voices and they began to get louder, like the people were getting closer. She recognized the voices as immediate family members. The report continued to

The report continued to allege that when the light in the living room turned on, the suspect stopped touching the victim inappropriately. The suspect then spoke to the approaching party and offered to bring the victim home. After the victim refused for the suspect to bring her home, another family member offered to bring them home.

The victim explained why she waited five months to report the incident. She stated she didn’t want to make a big deal the night of the incident because she didn’t want to scare the children.

She was also worried that reporting the incident would “put a wedge” between the family. After speaking with a therapist for a while because of the incident, the victim said she found the strength to report it. On March 10, an alleged

On March 10, an alleged witness to the incident arrived at the Marshall County Jail to give their account of what allegedly happened. She stated that there was a family function, and everyone was drinking and having a good time. The witness alleged that

The witness alleged that she only had one drink due to kids being at the function. The victim told the witness that she wanted to lay down, and noted that there was nobody else in the living room when she left the victim.

The witness also alleged that after she walked their son to the restroom, and was walking him back out, she noticed Cryer in the living room. She inquired as to why he was in the living room, to which he replied, “to see who was all down here.”

She stated that more people came inside, and that was when she allegedly noticed that the victim’s blanket and shorts had been moved and was exposing her private area.

At that point, the witness alleged that Cryer began pacing “back and forth behind the couch.” She also stated she didn’t cause a scene because of the children, and there was a firearm on property.

The witness then alleged that she noticed another person looking distraught, and that person claimed she also saw Cryer inappropriately touching the victim.

On May 11, another witness arrived at the Marshall County Jail to give her statement on the incident. She said she couldn’t remember any specifics about the alleged victim’s clothes. She also noted that even though she could only see the suspect’s shadow from her vantage point, she could see him hovering over the victim.

The suspect and his witness arrived at the Marshall County Jail on March 16 to give their account of the events that allegedly took place. After Floyd read Cryer his Miranda Warning, she questioned him about the night in question.

Cryer stated he was intoxicated, and could not remember anything. He also stated that his witness was with him the entire evening. He also denied making inappropriate comments to the victim.

Cryer’s witness was next to give their account of that night’s event. She stated that she arrived with Cryer at approximately 6:00 p.m., and that she was with the suspect the entire night.

Floyd questioned Cryer’s witness if she heard Cryer make any appropriate comments. She said she had not. Floyd then asked if there was any time during the night when Cryer was out of her sight. According to the police statement, the witness hesitated for a minute and replied that Cryer was inside the house, out of her sight for approximately 15 to 20 minutes.

The witness also stated that the victim was also inside when Cryer was inside the residence.

Cryer is currently facing charges for Rape by Instrumentation. An online search found no Oklahoma priors. If convicted, Cryer could face five years to life.
